Wholesale Terms and Conditions

ORDER MINIMUMS. Initial Opening Order 5 LB. Minimum reorders 1 LB.

 

SHIPPING. Products are made to order and ship within 7-10 days of order confirmation. We typically ship via USPS. Please inform us if you have an alternative preference. Plum Deluxe will not be responsible for damages or delays in shipping resulting from acts or events outside of the reasonable control of Plum Deluxe. Title to items being purchased passes from us to you at the time of shipping. You agree to take on full liability for safety and validity of delivery address given to us at the time of purchase. Plum Deluxe will not incur any forwarding costs on shipments. Plum Deluxe is not responsible for fees, taxes, tariffs, and/or brokerage fees associated with your shipments.

 

PRICING. Our suggested retail price of individually packaged teas (MRSP) is $7/oz. In recognition of the investment in time and resources required for our high-quality teas, and to provide the level of customer service and product knowledge expected from our customers, Plum Deluxe is committed to enforcing policies which allow our resellers to maintain high profit margins through the sale of our products. Our Minimum Advertised Price (MAP) for individually packaged teas is $6/oz (approx 15% discount on MRSP). Free shipping and/or handling, 0% sales tax, or free financing promotions do not violate the MAP. Wholesalers may request an exemption on this policy for limited-duration promotions. Custom blends are not subject to MAP pricing.

 

AVAILABILITY. Because Plum Deluxe purchases the freshest ingredients as close to directly from the source, availability of items is not guaranteed. Delays in shipping, weather, and other factors out of the control of Plum Deluxe may affect product availability.

 

WEB COMMERCE AND 3RD PARTY SALES. No products or goods purchased from or produced by Plum Deluxe shall be resold by or through any on-line auction or online store (eBay, Amazon, etc.) without the express, written authority of Plum Deluxe. Wholesale accounts may sell their own custom blends online, however. Plum Deluxe does not allow for wholesale accounts to act as a distributor and resell Plum Deluxe goods and products.

 

PAYMENT TERMS. In general, all orders must be accompanied by pre-payment. We accept credit card payment online. Plum Deluxe is currently not extending credit terms.

 

RETURNS. Order errors must be brought to Plum Deluxe attention within 5 business days of receipt of shipment. There are no returns on orders unless an error has been made by the Plum Deluxe warehouse.

 

DISCLAIMERS. Statements made by Plum Deluxe regarding the teas offered have not been evaluated by the United States Food and Drug Administration as the FDA does not evaluate or test herbs. This information has not been evaluated by the FDA, nor has it gone through the rigorous double- blind studies required before a particular product can be deemed truly beneficial or potentially dangerous and prescribed in the treatment of any condition or disease. The teas offered on Plum Deluxe are not intended to treat, cure or prevent any illness or disease.

 

MERCHANTABILITY AND MISREPRESENTATIONS. Wholesale Account agrees that Plum Deluxe makes no warranty, express or implied, as to the merchantability of Plum Deluxe products. Wholesale Account also agrees that Plum Deluxe is not liable for any misuse or misrepresentations of the goods by the Wholesale Account or the final retail purchaser or consumer, and indemnifies Plum Deluxe for any legal actions that emanate from such actions.

 

RIGHT OF REFUSAL. Plum Deluxe reserves the right to refuse or revoke wholesale access to our products to anyone for any reason at any time.

 

Confirmation of Agreement to Policies, Terms & Conditions.

I agree that I will not file a chargeback with my issuing bank and understand in doing so, I give Plum Deluxe the right to take legal action to enforce these conditions. In the event Plum Deluxe must seek legal action to enforce these conditions or collect a debt, defendant shall bear legal fees. I agree that I will not allege to consumers that I manufactured these products myself, nor appointees of myself. I have reviewed and understand Plum Deluxe policies and procedures for payment and shipping as well as all terms and conditions. I authorize Plum Deluxe to keep this agreement on file and apply these policies to all future transactions made between Plum Deluxe and myself. Plum Deluxe Tea reserves the right to change the terms of this Agreement as necessary. Prices are subject to change without notice.
